The Government of Alberta has appointed the Alberta Dispute Adjudication for Construction Contracts (ADACC) as a designated Nominating Authority, marking a significant step in the administration of the province’s prompt payment legislation.
Appointed by the Minister of Service Alberta and Red Tape Reduction, ADACC is now responsible for overseeing construction-related adjudications under the Prompt Payment and Construction Lien Act (RSA 2000, c P-26.4) and the Prompt Payment and Adjudication Regulation (Alta Reg 23/2022).
The organization is effectively the Alberta counterpart to the Ontario Dispute Adjudication for Construction Contracts (ODACC). Both bodies are operated by ADR Chambers, a Toronto-based dispute resolution firm that also administers the federal adjudication regime (CanDACC).
The ADACC’s mandate focuses on the administration of adjudication processes across Alberta. Responsibilities include training and qualifying adjudicators for the roster and appointing them to resolve payment disputes. The organization aims to ensure disputes are handled quickly, cost-effectively, and fairly, in strict accordance with the legislation.
The adjudication process allows parties involved in construction disputes to reach resolutions rapidly. This speed is intended to help stakeholders maintain necessary cash flow and preserve business relationships, ensuring construction projects can proceed without interruption.
